MenaPay Privacy Policy
This MenaPay Privacy Policy (‘Policy’) is prepared for the purpose of informing about policies concerning any operation which is performed upon Personal Information such as collection, recording, storage, preservation, alteration, adaptation, disclosure, transfer, retrieval, making available for collection, categorization or blocking its use wholly or partly by any means, in relation to the information providing by you who decide to use the website ico.menapay.io or MenaPay mobile application, (“Platform”) operated by us (‘MenaPay’, ‘We’).
By using the Platform, you explicitly consent us, to proceed, use and store your Personal Information in accordance with this Policy.
This Policy is an integral part of the MenaPay Terms and Conditions. The definitions contained in the MenaPay Terms and Conditions shall be taken in consideration for the statements not defined herein. The provisions of Terms and Conditions shall be applicable for the matters not stipulated under this Policy.
1. Personal Information We Collect
Personal Information refers to any information such as your name, surname, user name, password, e-mail address, mobile phone number, date of birth, wallet or crypto money addresses, location data, registration details, financial information, credit and debit card information, transaction details, your chat data and other technical information as collected under Clause 2.(iii).
2. How We Collect Your Personal Information
As MenaPay, we collect information about you (i) when you voluntarily share such information with us while using the Platform, (ii) from other resources such as merchant sites from which you buy or sell goods or services by using MenaPay Services or banks and other payment institutions that we cooperate with to provide you our Services or (iii) automatically from computer, mobile phone, tablet, and such devices used by you while you are using the Services on the Platform, either through cookies or by other means, in accordance with the purposes stated in the Policy, such as: (a) Server Diary Information: When you use Our Platform; your login information, visit dates and times, pages viewed, your IP address, the time you spent on our Platform or on the websites you visited immediately before and immediately after Our Platform, (and including but not limited to this) server diary information, (b) Device Information: Information about the computer or mobile device you use to access the Platform, including hardware model, operating system and version, web browser and other device identifiers that you use, (c) Telemetry Information: If you use any of our open source software, the band width loading and download speeds, the amount of free and used storage space on your device, and other statistics about your device and (d) Usage Information: As long as you use the Platform, metadata about the files you upload for storage, and examples of which you use your private key to verify communication.
3. How We Use Your Personal Information
We use your Personal Information for:
(i) Setting up and logging-in to user account on MenaPay and verifying your identity;
(ii) Providing you with MenaPay Services and related user services;
(iii) Assessing, detecting, investigating, preventing or remediating fraud or other potentially prohibited or illegal activities or breaches, conducting KYC process and otherwise protecting the integrity of Platform;
(iv) Making disclosures as may be required by any law or regulation, government official or other third party, including any card association or other payment network. Such disclosures may also be made pursuant to any subpoena, court order or other legal process or requirement applicable to us or any MenaPay Group company (including “know your customer”, anti-money laundering and counter-terrorist financing reporting requirements or other commercial disputes);
(v) Providing customer support services and location-based services; improving and optimizing the MenaPay Services for all users;
(vi) Managing our business such as protecting users, maintaining the security of our Services and products or other purposes as specified in Clause 4 herein.
4. With Whom We Share Your Personal Information
We share your information with selected recipients who have a legal basis and valid jurisdiction to request such information including:
(i) law enforcement agencies, insurers, government and regulatory authorities or any other organizations: to which MenaPay, or any MenaPay related group company or third party service provider is under an obligation to make disclosure under the requirements of any applicable law, regulation or commercial arrangement;
(ii) related group companies and our advisors: in order to provide our Services;
(iii) third party service providers: service providers supplying services to support our Services. We work with third parties to help us with fraud prevention, AML checks, credit checking, bill collection, data entry, database management, promotions, marketing, customer service, technology services, products and services alerts and payment extension services;
(iv) entities with whom MenaPay maintain commercial arrangements, including merchants, online merchants, and other companies; and
(v) banks, card associations, payment networks or acquiring institutions, involved in processing of payments through our Services yet all credit/debit cards’ details and personally identifiable information will not be stored, sold, shared, rented or leased to any third parties. MenaPay will not collect or pass any debit/credit card details to third parties.
We reserve the right to allocation or switching of Personal Information in connection with events related to the takeover or assignment of MenaPay in whole or in part by a third party, bankruptcy or a similar event.
5. How We Store and Protect Your Personal Information
We will keep your Personal Information for as long as it is necessary to provide you with the Services or other purposes as set out in this Policy. In addition, we may retain your Personal Information for a longer period (including after you are no longer a User), if it is necessary to comply with laws and regulations applicable to us.
We use a variety of security measures and technologies to help protect your personal information from unauthorised access, use, disclosure, alteration or destruction consistent with applicable data protection and privacy laws and regulations.
Please be aware that despite our efforts, no data security measures can guarantee 100% security at all times. We do not warrant or guarantee the security of MenaPay or any information you provide to us through MenaPay.
6. Your Rights
You can review, update or delete your Personal Information collected by the Platform or through our Platform by logging in to your account and reviewing your account settings and profile.
If you believe, we hold any other Personal Information, or you want to correct or erase your Personal Information that you are unable to correct using your account, please contact us via info@menapay.io. We may not be able to provide you with certain Personal Information if providing it would interfere with another’s rights (e.g. where providing the Personal Information we hold about you would reveal information about another person).
You may request us to erase your Personal Information in the following circumstances:
• you believe that it is no longer necessary for us to have your Personal Information;
• we obtained your consent to process the Personal Information and you withdraw that consent (and we have no other grounds for processing the Personal Information);
• you believe we are unlawfully processing your Personal Information; or
• you are breaching Clause 8 herein and we can verify your age.

From time to time, the Platform may contain links to websites or applications of our business partner networks, our sponsors, and our associates. Please mind you that if you follow a link on any of these websites or applications, these websites or applications have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before submitting your Personal Information to these websites or applications.
8. Process of Personal Information About Children
Our Services is not directed towards children under 18 years old If you are under 18, please do not use MenaPay Services or submit any Personal Information to us.
9. Changes on Privacy Policy
MenaPay has the right to make changes to this Policy through the Platform, at any time. Therefore, please visit these the Platforms in order to aware of such changes. We may also notify you of any substantive or material change in this notice by sending push notifications, e-mails or letters, by phone or by publishing announcements on our web or application, as applicable. All changes made are published on the Platform and come into force from the date of publication.
